AquaCure.Life Terms and Conditions of Sale
The following terms and conditions govern the sale of products by AquaCure.Life, a website supported by AquaCure International Inc. By submitting your on-line order to AquaCure.Life, you have indicated your acceptance to be bound by these terms and conditions of sale. At AquaCure.Life sole discretion, these terms and conditions may be changed without prior notice at any time before AquaCure.Life accepts your order.
Prices
All prices are in USA dollars.
Product prices shown on the AquaCure.Life’s site do not include shipping and handling, those are added during checkout.
The prices do not include taxes unless otherwise noted. If applicable, taxes are added during checkout.
The prices do not include customs duties when shipped internationally. Those will be applied by the country’s customs and the bill sent to the customer. The taxes and duties are the responsibility of the customer.
The price charged for an order will be the price in effect at the time the order is made. If there is a reason to consider a lower price, contact customer service. AquaCure.Life/contact
Payment Terms
Payment is due by credit card, PayPal, Certified Check, Money Order, Crypto, Bank Draft, Bank Transfer or Affirm.
Once an order is placed by credit card, the credit card account will be verified at the time the order is placed. Should a credit card be declined, the order will be put on hold until payment is made.
No C.O.D. orders are accepted. Orders are processed ONLY upon confirmation of payment.
Shipping and Handling Policies
The AquaCure.Life mailroom currently ships Monday-Thursday.
Orders are typically processed for shipment next business day after order payment is confirmed.
The exception is if there are a massive number of orders due to a sale or promotion, but even then it shouldn’t take more than a few days to process the order as we maintain good inventory of products.
The AquaCure.Life website calculates the shipping charge and posts it after you put in your shipping address.
The AquaCure Team chooses the best service and method available to ship your products to you.
Currently that is usually FedEx but could be DHL, UPS or Post. We always choose the fastest practical method.
In North America shipping time is usually 3 to 5 days if shipped by courier. Elsewhere in the world the shipping time is about a week plus whatever time customs delays the order.
If you have a preferred shipping service, please mention it in the Order Notes (more information) and we will do our best to accommodate.
Note that the courier services will not deliver to a Post Box so a Post Box choice of a shipping address will result in delivery by Post, which has taken up to a month to deliver in North America and 3 months elsewhere.
Payment Shipping and Handling Charges and Taxes
You are responsible for any taxes, customs, or tariffs associated with your purchase.
Shipping & Risks during Shipping
When products are shipped to you by common carrier, AquaCure.Life’s liability to you for breakage and/or non-delivery of the products by the common carrier to you will be limited by the limits of liability provided by the common carrier’s terms and conditions of carriage.
When applicable, we purchase insurance from loss or breakage during carriage for full insurable value of the products you have ordered. We take care of any issues and would replace items lost or damaged so you do not need to worry about loss.
Satisfaction Guarantee
AquaCure.Life guarantees satisfaction or refund of the product’s purchase price (less a 10% restocking fee) upon proper return.
Except where specified on an AquaCure.Life order page, the default time period for the Satisfaction Guarantee is 60 days from date of shipment. Some products have a 1 year time period; be sure to check the order page.
Manufacturer’s Warrantee
For products we manufacture ourselves we have a default Manufacturers Warrantee of 1 year from date of shipment.
Except where specified on an AquaCure.Life order page or promotion, the default time period for the Manufacturer’s Warrantee is 1 year from date of shipment. Some products have a Lifetime Manufacturer’s Warrantee; be sure to check the order page for details.
The Manufacturer’s Warrantee covers shipping, parts and labor to appropriately fix.
The Manufacturer’s Warrantee does not cover unapproved customer damage. Often we authorize customer repairs and if those repairs don’t work, we will still honor the Warrantee; but check with us FIRST to get approval.
Upgrades: Note that if the Product come in for repair, the customer can pay extra to have the product factory upgraded, if there are upgrades available.
Disclaimer of Warranty
When products are shipped to you, the limited warranties applicable to products are in effect and are detailed on the website. Certain products may have additional warranties provided by the original manufacturer but not by AquaCure.Life.
On our website, “as is” products may not have warranties from AquaCure.Life (other than those warranties implied by and incapable of exclusion, restriction or modification under applicable law), but may still hold warranties from the manufacturer.
Limited Warranty
AquaCure.Life warrants product(s) that they manufacture to be in good working condition and free from defects in material and workmanship for a period of one (1) year for OEM products, or thirty (30) days for RETAIL packaged re-sale products, from the original Invoice date unless otherwise restricted below or by the manufacturer’s own warranty policy.
AquaCure.Life’s liability shall as limited to repairing or replacing, at its option, any defective product which is returned, freight prepaid to AquaCure.Life, according to the Merchandise Return Procedure set forth in Section Merchandise Return Procedure below. Buyer shall bear all responsibility for shipping charges and risk of loss or damage during transit to AquaCure.Life. Products which have been subjected to abuse, misuse, alteration, neglect or unauthorized repair or installation, as determined solely by AquaCure.Life, are not covered by this warranty.
Any alterations, addition, improvements or attachments to the product(s) not authorized in writing by the AquaCure.Life shall be deemed to be a waiver of this warranty by Buyer and shall render this warranty null and void.
AquaCure.Life shall return repaired or replaced product(s) to Buyer, at its expense via regular ground service within North America (Mexico, USA and Canada). Shipping charges by all other methods and from or to all other destinations shall be borne by Buyer.
THIS WARRANTY IS IN LIEU OF ANY OTHER WARRANTY, EXPRESS OR IMPLIED. AquaCure.Life MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY. IN NO EVENT SHALL AquaCure.Life BE LIABLE FOR INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES SUCH AS LOSS OF PROFITS OR BUSINESS OPPORTUNITIES, AND IN NO EVENT SHALL AquaCure.Life’S LIABILITY EXCEED THE PURCHASE PRICE OF THE PRODUCT(S).
Return and Refund Policies
Except where specified on an AquaCure.Life order page, the default return for refund time period for returns is 60 days from date of shipment. Some products have a 1 year time period; be sure to check the product’s order page for specific exemptions and details.
Returns MUST first acquire a Returns Merchant Authorization (RMA) number and RMA instructions BEFORE returning the Products. Contact us for these prerequisites. AquaCure.Life/Contact
When contacting AquaCure.Life, be sure to include the product’s serial number and purchaser details.
If the RMA procedure is not followed, we reserve the right to reduce the refund by whatever extra costs might accrue to straighten out resulting issues.
Once an order is shipped, we do NOT refund shipping. That is a cost paid to a separate business on your behalf and that business provided the service for you.
There is a 10% administration, refurbish and restocking fee deducted from any refund. The 10% fee is based on the retail price of the item(s) being returned for refund.
Electronic Products are non-refundable after they’ve been accessed or downloaded.
Merchandise Return Procedure
A.
To obtain a “Return Merchandise Authorization”(RMA) Number, Buyer must:
1. Contact AquaCure.Life’s Customer Service.

2. Provide the serial number of items to be returned and ideally also provide the invoice number, date of purchase, and reason for return.
RMA numbers are valid for 30 days from date of issuance.
B.
Packing and Shipping
1. Including a copy of the RMA information with each item to be returned.
2. Pack items in original shipping containers, or equivalent, with all accessories, including manuals, cables, diskettes, etc.
3. Mark the RMA number clearly on the outside of each container.
4. Ship to AquaCure.Life, freight prepaid and insured.
C.
For Warranty Returns, replacement or repair is made when merchandise is received by AquaCure.Life. Advance replacement is available on a case by case basis.
D.
Buyer shall pay the following miscellaneous charges:
1. Items returned which were not originally purchased from AquaCure.Life: $30 plus return freight.
2. Items returned within warranty period; no defect found:
- Products: $50 plus return freight
- Parts: $35 plus return freight
3. Out of warranty Repair (Performed solely at AquaCure.Life’s election): $50 per hour labor plus parts and return freight.
Return Policy
Subject to a restocking fee of 10% of retail, AquaCure.Life will allow the return of most products for refund, under certain terms and conditions. The following procedures must be followed if you want to obtain a refund for a return item:
First, you must obtain a return authorization number (RMA) and instructions. Contact for details AquaCure.Life/Contact
Second, the return item must be accompanied by the return authorization number, received at the AquaCure.Life warehouse, evaluated by AquaCure.Life and the evaluation sent to the applicable authority before the refund will be issued. This process can take 3 to 4 weeks.
You must pay the shipping for returned items. A restocking fee of 10% of current retail will be subtracted from refund for returned items.
THIS RETURN POLICY IS NOT A WARRANTY. AquaCure.Life reserves the right to change or to cancel it at any time without notice. For all refunds, you need to precisely follow the RMA return procedures to ensure a smooth refund.
You need to also allow a reasonable period of time for the product to arrive at our warehouse and pass an inspection process and the paperwork sent to whomever is in charge of the refunds. When that paperwork arrives, we will process your refund as soon as possible.
Technical Support
AquaCure.Life provides technical support for products manufactured by AquaCure.Life.
Some products sold by AquaCure.Life may have to use the technical support provided by the original manufacturer.
Limitation of Liability
The maximum liability to you for products purchased from AquaCure.Life shall be limited to the purchase price you have paid for the products.
Also, AquaCure.Life will not be liable for any property damage, personal injury, loss of use, interruption of business, loss of profits, or other consequential, indirect, incidental, punitive or special damages.
This applies to all situations however caused, whether for breach of warranty, contract, tort (including negligence), strict liability or otherwise, other than those damages that are incapable of limitation, exclusion or restriction under applicable law.
Title
Title to hardware products and to the media in which software products are embodied passes to you upon shipment by AquaCure.Life. Title to software remains with the licensor of the software.
Title to purchases is non-transferable and remains with the original purchaser even if that purchaser subsequently gifts or sells the hardware.
Interpretation
These terms and conditions shall be interpreted under and governed by the applicable Federal and State of New York laws, without giving effect to conflicts of law rules. Headings used in these Terms and Conditions are for convenience of reference only and are not intended to be part of, or to affect the meaning or interpretation of, these Terms and Conditions.
Arbitration
All dispute, controversy, or claim against AquaCure.Life arising out of or relating to these Terms and Conditions, their interpretation, or the breach, termination or validity thereof, or any related purchase shall be resolved exclusively and finally by arbitration administered by the Better Business Bureau.(BBB)
The arbitration will be conducted before a single arbitrator, and will be limited solely to the dispute or controversy between you and AquaCure.Life. The arbitration shall be held in any mutually agreed upon location in person, by telephone, or online. Any decision rendered in such arbitration proceedings will be final and binding on each of the parties, and judgment may be entered thereon in a applicable court of competent jurisdiction.
The arbitrator shall not award either party special, exemplary, consequential, punitive, incidental or indirect damages, or attorney’s fees and each party irrevocably waives any such right to recover such damages. The parties will share the costs of the arbitration, (including the arbitrator’s fees, if any) in the proportion that the final award bears to the amount of the initial claim.
No Modification
Any additional or altered terms attached or adhering to an order shall be null and void and without effect, unless agreed to in writing by AquaCure.Life.
These terms and conditions may not be modified, altered or amended without the written agreement of AquaCure.Life.
AquaCure reserves the right to modify these terms and conditions without notification.
Severability
If any provision of these terms and conditions is held to be illegal, invalid or un-enforceable, in whole or in part, the legality, validity and enforceability of the remaining provisions shall not be affected or impaired.
The terms and conditions stated herein are declared to be Severable.
Assignment
You may not assign this agreement without AquaCure.Life’s prior written consent. AquaCure.Life is the intended beneficiary of this agreement.
Precedence
If there is any inconsistency between this agreement and other agreement included with or relating to products purchased from AquaCure.Life, this agreement shall take precedence.
